E-Cigarette
“Vaping product” means:
(a) a device that produces emissions in the form of an aerosol and is intended to be brought to the mouth for inhalation of the aerosol;
(b) a device that is designated to be a vaping product by the regulations;
(c) a part that may be used with those devices; and
(d) a substance or mixture of substances, whether or not it contains nicotine, that is intended for use with those devices to produce emissions.
It does not include devices and substances or mixtures of substances that are excluded by the regulations, tobacco products or their accessories.
For the purpose of this review, we will use the term “e-cigarette” when referring to a “vaping product.”
Vaping device
“Vaping device” means a device that produces emissions in the form of an aerosol and is intended to be brought to the mouth for inhalation of the aerosol.
Vaping part
“Vaping part” means a part that may be used with those [vaping] devices.
Vaping substance
“Vaping substance” means a substance or mixture of substances, whether or not it contains nicotine, that is intended for use with those devices to produce emissions.
For the purpose of this review, we will use the term “e-liquid” when referring to a “vaping substance.”
Emission
“Emission” means a substance that is produced when a tobacco product or vaping product is used.
Ingredient
“Ingredient” means any substance used in the manufacture of a tobacco product, vaping product or their components, including any substance used in the manufacture of that substance, and, in respect of a tobacco product, also includes tobacco leaves.
Includes tobacco, components (e.g. paper, filter), including materials used to manufacture those components, additives, processing aids, residual substances found in tobacco (following storage and processing), and substances that migrate from the packaging material into the product (contaminants are not part of the ingredients). Display surface
“Display surface” means the portion of the surface area of a vaping product or package on which the information referred to in this Part can be displayed. It does not include the surface area of the bottom, of any seam or of any concave or convex surface near the top or the bottom of a vaping product or package.
Main display panel
“Main display panel” means, in respect of a vaping product or package, the part of the display surface that is displayed or visible under normal or customary conditions of sale or use of the vaping product. It includes:
(a) in the case of a vaping product or package that has a rectangular cuboid shape, one of the largest sides of the display surface;
(b) in the case of a vaping product or package that has a cylindrical shape, the larger of
(i) the area of the top, or
(ii) 40% of the area obtained by multiplying the circumference of the vaping product or package by the height of the display surface;
(c) in the case of a bag, the largest side of the bag; and
(d) in any other case, the largest surface of the vaping product or package that is not less than 40% of the display surface.
Smoke
“Smoke” means to smoke, hold or otherwise have control over an ignited tobacco product or ignited cannabis or to vape using a vaping product.
The definition of “smoke” specifically includes the use of e-cigarettes (“vape using a vaping product”).
