Analysis

The law imposes fines ranging from 20,000,000 to 50,000,000 francs on anyone violating the law. The law also permits for an increase in penalties of up to half of the amount of the advertising campaign. In addition to monetary fines, any advertising activity must be suspended for up to one year. The law aligns with FCTC Art. 13 in that it provides a range of fines. To better align with FCTC Art. 13 Guidelines, the law should also impose cumulative fines, higher fines for repeat violations, and a range of sanctions including license suspension or revocation.
