Analysis

The Law on Tobacco Control authorizes the Ministry of Health to appoint its staff as inspection officers. The law authorizes these inspection officers to monitor and issue fines for non-compliance. However, neither the Law on Tobacco Control nor the Sub-Decree on Smoking imposes a duty to inspect and enforce no-smoking provisions.

To align with FCTC Art. 8 and the FCTC Art. 8 Guidelines, the law should impose a duty to enforce on inspection officers from the Ministry of Health or other authorized agency.
