The law does not define “tobacco sponsorship.” Having no definition for this key term makes interpretation of many provisions difficult. This can hamper application and implementation of FCTC Art. 13 and the FCTC Art. 13 Guidelines. A definition of “tobacco sponsorship” should be provided in accordance with FCTC Art. 1(g).

FCTC-Based Definition

Any form of contribution to any event, activity, or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use directly or indirectly. (FCTC Art. 1(g))

Tobacco Advertising and Promotion

“Advertisement of tobacco products” means conducting any kind of commercial programs for encouraging the direct or indirect usage of tobacco or tobacco products.

Analysis

The definition covers much of the scope of the FCTC-required definition for “tobacco advertising and promotion”; however, the Bangladesh definition only covers commercial programs with the aim of promotion tobacco, while the FCTC definition also includes commercial actions that have the effect or likely effect of promoting tobacco. In order to cover the full range of tobacco advertising and promotion, the law should include the broader definition as provided for in FCTC Art. 1(c).

(b) “Tobacco” means any Nicotima Tobacum or Nicotima Bustica plant or any other related plant or its leaf or crop, root, branch or any part of it.

(c) “Tobacco products” means any product made from tobacco, tobacco leaf or its extract which can be sucked or chewed, or inhaled through smoking, and shall include bidi, cigarette, cheroot, gul, jarda, khoinee, sadapata, cigar and mixture used in pipe or hukkah.
