“Tobacco product sponsorship” means any type of contribution of tobacco manufacturers and sellers to any event that promotes the sale and use of tobacco products.

Analysis

The definition of "tobacco product sponsorship" does not align with the definition of “tobacco sponsorship” contained in FCTC Art. 1(g). To align, the definition should include that sponsorship could promote tobacco use directly or indirectly.

FCTC-Based Definition

Any form of contribution to any event, activity, or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use directly or indirectly. (FCTC Art. 1(g))

Tobacco Advertising and Promotion

"Advertising” means information disseminated in order to attract the attention of the advertisement consumer to the object of advertising in any form using various means and methods, to form and maintain interest, to promote the product in the market and to stimulate sales.

Analysis

The Law on Advertising contains a general definition of “advertising” that is not specific to tobacco control. The definition is more limited than the definition contained in FCTC Art. 1(c) because it includes only information disseminated in order to attract consumer attention, as opposed to communications, recommendations, and actions with the aim, effect, or likely effect.

A definition of “tobacco advertising and promotion” should be provided in accordance with the definition provided in FCTC Art. 1(c).

FCTC-Based Definition

Any form of commercial communication, recommendation, or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. (FCTC Art. 1(c))

Tobacco Product

“Tobacco products” means products made of tobacco leaf and its components, containing nicotine, active alkohydrate, carcinogenic substances and nicotine-addiction developing products (cigarettes, cigars, cigarillos, rod tobacco etc.). All kinds of hookahs and electronic cigarettes are also equated with tobacco products within the scope of this law.

Analysis

The definition of “tobacco products” contained in the law aligns with the definition of “tobacco product” contained in FCTC Art. 1(f).

FCTC-Based Definition

Any product entirely or partly made of the leaf tobacco as a raw material which is manufactured to be used for smoking, sucking, chewing, or snuffing. (FCTC Art. 1(f))
