Enforcement Authorities
By federal regulations, the Civil Aviation Safety Authority and/or the owner or operator of an airline has a duty to enforce smoking prohibitions on aircraft.
By federal regulations, the owner or operator of an airport has a duty to enforce smoking prohibitions in airports.
By federal regulations, the National Transport Commission and the operator of an interstate bus line have a duty to enforce smoking prohibitions on interstate buses.
In States and Territories, the local Department of Health has jurisdiction over enforcement of smoking restrictions and prohibitions. A full analysis of all those sub-national laws is beyond the scope of this national legislation database and therefore whether or not a duty is imposed on the authorized agency is not explored here.
