COMMENTS: The Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 replaces the tobacco retailer registration scheme with a tobacco retailer licensing scheme, places restrictions on the sale and advertising of e-cigarettes, updates penalties for offenses, and amends certain provisions of the PHA 2002 (and amendments).
Most provisions of the Act came into effect on December 22, 2023, with select provisions entering into force on May 29, 2024 (Sec. 33), September 23, 2024 (Secs. 29, 30, 31), and September 29, 2025 (Secs. 26, 45(a)-(b)).
To the best of our knowledge, all laws provided here are in effect as of November 20, 2025 unless otherwise noted.
